The Vermont State Police were notified that Tim Foley, age 47 of Leicester, will be arraigned Monday at Rutland Criminal Court at 1 pm to answer to the charges of two counts of attempted aggravated murder and two counts of attempted murder. The male victim, identified as Mahlon McCoy age 64, continues to received medical treatment at Fletcher Allen Medical Center and is in good condition.

The troopers that responded to the defendant's residence and were subsequently shot, are identified as Sergeant Eugene Duplissis and Trooper Matt Daley. Sergeant Duplissis, age 36, has been with the Vermont State Police since 2001 and Trooper Daley, age 34, has been with the Vermont State Police since 2005. Both are currently assigned to the New Haven Barracks; and were placed on paid administrative leave per policy.
Foley was arrested Sunday and processed at the New Haven Barracks for two counts of attempted aggravated murder, related to the on-duty troopers, and two counts of attempted murder, related to the residents that live at 1496 Lake Dunmore Road. Foley was lodged at the Marble Valley Regional Correctional Facility for a lack of $100,000 bail.
At a press conference Sunday, VSP Colonel Tom L'Esperance provided the following statement regarding shooting:
"During the early morning hours of April 6th, at approximately 2:58 am the Vermont State Police received a 911 call from a female who reported that someone had come into her residence and shot her husband.
"Troopers from the Vermont State Police New Haven barracks along with officers from the Brandon Police Department and emergency responders with Brandon Rescue responded to the residence, located at 1509 Lake Dunmore Road in the town of Leicester. The victim was transported by to Porter Hospital in Middlebury and was treated for an gunshot wound to the head. Subsequently was transported to Fletcher Allen Medical Center, where he is stable condition.
"Initial information received from the female caller indicated that an unknown subject entered their residence while they were in bed. This subject reportedly shot the victim one time and then left the residence.
"Responding troopers developed information leading them to the residence of Timothy Foley, age 47 of Leicester, located at 1496 Lake Dunmore Road and directly across the street from the victim's residence. Troopers attempted to make contact with Foley but he would not come outside. A trooper was able to speak with Foley by phone from a neighbor's residence and tried to get him to come out of the house; at the same time Troopers set up a perimeter outside the house. At some point shots were fired from inside the residence at Troopers who had taken cover behind a tree located in the front yard. One of the troopers was struck in the head with shotgun pellets. Another trooper returned fire at the house while attempting to allow the injured Trooper get to a safe location. The second trooper was subsequently shot at and was also struck in the head with shotgun pellets.
"Both troopers were able to move to a safe area at which time they were transported by troopers to Porter Hospital in Middlebury for treatment of non-life threatening injuries. One trooper has since been treated and released. The other trooper was subsequently transported to Fletcher Allen Medical Center and receiving additional medical treatment.
"Following the shooting, a Vermont State Police Hostage Negotiation Team member was able to re-establish telephone contact with Foley. Foley agreed to exit his residence and was taken into custody without incident. Foley was transported to the New Haven barracks and remains in custody.
"Detectives from the Vermont State Police Bureau of Criminal Investigation responded to investigate both shooting incidents. Members of the Crime Scene Search Team responded to process the scene. A search warrant was obtained for Foley's residence.
"The Addison County State's Attorney responded and is working closely with detectives; and charges are forthcoming. At this time, the names of the male victim and troopers are being withheld per protocol."
