Mayor calls Special Election for December 6 to fill Burlington East District City Council seat

Vermont Business Magazine Burlington Mayor Miro Weinberger will call a Special Election to fill the East District City Council seat, following the resignation of Councilor Jack Hanson. In accordance with all applicable City Charter and State Statute provisions, the Special Election will take place on December 6, 2022. Hanson, a Progressive, announced he was stepping down on September 13 to apply for a job at the Burlington Electric Department.

Special Election timeline:

·Today, Tuesday, September 21 – Candidate petitions available at the Clerk/Treasurer's Office in City Hall.

·Tuesday, October 11 – Filing deadline for candidates.

·Monday, October 24 – Early voting will begin at City Hall. All active, registered voters in the East District will receive mailed ballots.

·Tuesday, December 6 – Special Election. The polling locations for the Special Election will be the Fletcher Free Library and the Mater Christi School from 7:00 am – 7:00 pm on Tuesday, December 6, 2022.

The applicable City Charter provisions are as follows:

·Subchapter 5: Officers, § 3-128. Manner of filling (c)(1)
In case there shall arise an occasion for any such new election, as a result of a vacancy in the Office of Mayor or City Councilor for any of the causes described in this section, the same shall be held within 90 days of the date of such vacancy, provided such vacancy shall occur before the first day in October in any year, unless a citywide election has been prescheduled to occur between the 90th and the 120th day of the date of such vacancy, in which case the same shall be held on such prescheduled election date; otherwise it shall be filled at the next annual City election.

·Subchapter 2: Elections And City Meetings; City Elections, § 3-3. Election of Mayor and City Councilors
For all special elections, nominations of the municipal officers shall be by petition as specified in 17 V.S.A. chapter 55, excepting 17 V.S.A. § 268l(a)(1)(A). Instead, the petition shall be filed with the municipal clerk, together with the endorsement, if any, of any party or parties in accordance with the provisions of this title, not later than 5:00 p.m. on the ninth Monday preceding the day of the election, which shall be the filing deadline.
