Vermont ranks #5 in the 2022 LGBTQ+ Business Climate Index

Vermont Business Magazine For Pride Month, Out Leadership, the premier global network for LGBTQ+ business leaders and companies, unveiled the 4th annual State LGBTQ+ Business Climate Index for 2022. The Index is a ranking from highest to lowest of all 50 states as it relates to legal, political, emotional support, health, business and other parameters for LGBTQ+ Americans. Vermont ranked as #5 in the 2022 LGBTQ+ Business Climate Index.

Vermont did well in all the subcategories except Work Environment & Employment.

The top 10 states are New York (ranking #1), Connecticut, Massachusetts, New Jersey, Vermont, Maine, Illinois, Oregon, California and Colorado, while the bottom 10 states are Montana, Texas, Alabama, Mississippi, Louisiana, Arkansas, South Dakota, Tennessee, Oklahoma, and South Carolina (ranking last at #50). There was a very clear Blue State/Red State divide, only Alaska and North Dakota were in the top 25 of states who did not support Joe Biden for president in the last election and only Arizona and Georgia, which did, were in the bottom 25 of this ranking.

LGBTQ+ Business Climate Score

Out Leadership’s Business Climate Index for the 50 United States is an assessment of states’ performance on LGBTQ+ inclusion. It measures the impact government policies and prevalent attitudes have on the LGBTQ+ people residing in each state, quantifying the economic imperatives for inclusion and the costs of discrimination. It equips business leaders and policymakers with a clear sense of the most impactful steps states can take to make themselves more hospitable to forward-thinking, innovative, inclusive businesses.

Legal & Nondiscrimination Protection

Vermont has comprehensive nondiscrimination laws inclusive of sexual orientation and gender identity. Changing gender markers on a birth certificate requires a court order but no surgery. Changing the gender markers on a driver’s license, which includes a nonbinary option, does not require any supporting documentation at all.

Youth & Family Support

Conversion therapy for minors is banned in Vermont. Youths in foster care have strong protections against discrimination or mistreatment on the basis of sexual orientation or gender identity. There is no religious exemption that would allow adoption agencies to discriminate against prospective LGBTQ+ parents.

Political & Religious Attitudes

Vermont’s Governor and U.S. Senators consistently speak and vote in favor of LGBTQ+ equality and inclusion. Religious organizations are allowed to make employment decisions that “promote the religious principles for which it is established or maintained.” This exemption does not allow employers to use religious beliefs as a justification for discrimination.

Health Access & Safety

There are comprehensive hate crimes protections for LGBTQ+ people in Vermont. HIV status is not criminalized in the state. Insurers in the state, including Medicaid, must cover trans-related healthcare.*

Work Environment & Employment

5% of transgender employees in Vermont reported being harassed in the past year due to their gender identity, and 14% report mistreatment such as being forced to use a restroom not matching gender. 27% of LGBTQ+ individuals in Vermont reported food insecurity, almost double the rate for non-LGBTQ+ people (14%). Up to 27% of LGBTQ+ individuals in Vermont reported making less than $24,000 per year. 7% of LGBTQ+ individuals report unemployment in Vermont, almost double the rate for non-LGBTQ+ people (4%).

The State LGBTQ+ Business Climate Index, published against a backdrop of sustained attacks on transgender and LGBTQ+ rights in state legislatures around the U.S., gives each state a score out of 100 points, based on 20 carefully selected and nuanced markers assessing LGBTQ+ people’s lived experiences across 5 broader categories including Legal and Nondiscrimination Protections, Youth and Family Support, Political and Religious Attitudes, Health Access and Safety, and Work Environment and Employment.

The 2022 Index results reveal some significant steps forward for some states. At the same time, the coordinated legislative pushback against LGBTQ+ rights on a state level have caused some states to fall farther behind when it comes to protecting their LGBTQ+ citizens.

Highlights of the State LGBTQ+ Business Climate Index for 2022:

  • New York is the highest ranking state in LGBTQ+ equality for the second year in a row, scoring 93.67 out of 100 points, an increase of 1 point.

  • South Carolina is the lowest ranking state in LGBTQ+ equality for the third year in a row, scoring 33.63 out of 100 points.

  • The highest mover was Alaska, with an increase of 8.1 points between 2021 and 2022. This was due to the implementation of positive legal & nondiscrimination protections, as well as improvements in youth & family support.

  • The second highest mover was Michigan, as a result of new anti-workplace discrimination policies, health insurance protections for the LGBTQ+ community, and a ban on the use of government funds on conversion therapy for minors.

  • The largest changes in scores between 2021 and 2022 were as a result of changes in Legal and Nondiscrimination Protections, as well as Youth and Family Support.

  • This year’s Index reveals the impact of recent anti-LGBTQ+ legislation in states such as Florida, Texas, Oklahoma, Montana, and Kentucky.

  • In Oklahoma, the impact of a “Don’t Say Gay” bill moved the state down 3 places from 45th to 49th place.

  • Florida’s version of the same bill, amongst other anti-LGBTQ+ state legislation, caused a 3.4 point decrease, the third greatest decrease out of all states.

  • The average score across all 50 states was 64.61 out of 100 - a slight increase on last year’s average 64.03.

  • The gap between the top states and the lowest states continues to grow. While the top ranked states for LGBTQ+ equality broadly increased in score, the bottom ranked states decreased in score or remained stagnant - this signals increasing polarization across the country in political and cultural attitudes toward the LGBTQ+ community.

  • To what extent does the state allow for religious exemptions from its laws?

Health Access and Safety

  • Do LGBT+ people, particularly the most vulnerable and economically precarious, have access to health care and insurance?

  • Do state employees receive transgender-inclusive health benefits?

  • Are LGBT+ people protected by any hate crimes laws in the state?

  • Is exposure of others to and transmission of HIV criminalized?

Work Environment and Employment

  • At what rate are transgender people subjected to harassment at work?

  • What percentage of LGBT+ people are unemployed, and how does it compare to the unemployment rate of non-LGBT+ people in the state?

  • What percentage of LGBT+ people experience food insecurity, and how does it compare to the unemployment rate of non-LGBT+ people in the state?

  • What percentage of LGBT+ people have an annual income below $24,000 (approximately the federal poverty line)?
