Public Service Department asks court to deny New England Coalition’s complaint against Vermont Yankee

The Public Service Department today filed its response in Vermont Supreme Court to the New England Coalitions (NEC) complaint for injunctive relief against Entergy/Vermont Yankee. Arguing that the Public Service Board has not chosen to order the relief now sought by NEC, and that pending Board proceedings provide adequate procedures and remedies to address the continued operation of Vermont Yankee, the Department asked the Court to deny NECs petition.
Acting PSD Commissioner Christopher Recchia said While the Public Service Department appreciates NECs committed advocacy in deciding to file a complaint with the Vermont Supreme Court seeking to force Entergy to shut down Vermont Yankee immediately, the Department is focused on the pending Public Service Board proceeding set for hearings in February. The Department, along with NEC and other parties, has filed testimony with the Public Service Board opposing Entergys request for a new Certificate of Public Good. The Department has asked the Supreme Court to deny NECs request for relief because we believe the question of continued operation of Vermont Yankee is squarely before the Board and should be decided through the ongoing proceedings, Recchia added.
The Public Service Department is an agency within the executive branch of Vermont state government. Its charge is to represent the public interest in matters regarding energy, telecommunications, water and wastewater.
